Domestic partners, spouses in a same-sex marriage, or their children are not eligible for the subsidy unless they meet the Federal definition of a “dependent” of the assistance eligible individual. The reason for this is that COBRA is a federal law and federal law does not recognize domestic partnerships or same-sex marriages.
