Yes, due to AB 2208’s spouse-equivalent provisions, health plans are prohibited from requesting copies of state registration unless we also request copies of marriage licenses. Because Blue Shield of California does not require marriage licenses, we will not require copies of state registration. Blue Shield of California decided to adopt the same position for broad coverage regarding the affidavit requirement. See following exception for individual and family plans (IFP). Blue Shield does not require that employers or employees submit a copy of the affidavit to validate the domestic partnership. Enrollment of domestic partners during initial and open enrollment periods and during the year when a partnership is established is exactly the same as a spouse. The January 2005 employee application asks for the same information for a partnership as it does for a marriage.
