Are contracts binding upon death of sole proprietorship?
In most cases, yes. An obligation to perform a contract will fall to the estate (especially if the obligation is to pay money). If the obligation was something only the deceased could do (i.e. a specialized skill), then the contract may be frustrated by the death and the parties will be releived from their obligations. In that case, any money paid to the deceased in advance must be returned to the payor.
