Contractors with “Building Access Only” badges are not required to be drug tested unless they otherwise meet one of the description for a TDP provided in 10 CFR 707.7, such as those provided in § 707.7(b)(1) and (2). Individuals that meet the TDP requirements of § 707.7(b)(1) and (2) should already be covered in an existing substance abuse program as this rule was promulgated in 1992. Testing designated positions include individuals with “Q” and “L” security clearances which must be included in the dug testing program in addition to the positions described in § 707.7(b)(1) and (2).
