Are conservative activist judges any better than liberal activist judges?
Pres. Obama nominated, to no one’s surprise, Sonia Sotomayor because she “is an inspiring woman who I believe will make a great justice.” Her record combined with her comments over the years leaves no doubt she will be a Supreme Court Justice without a blindfold. Many are saying she will be an activist judge. This sentiment is being broadcast by many, including Utah Senator Orrin Hatch who has been appearing on many shows warning and now confirming Obama’s pick will be an activist judge. What does that mean? Quite simply it is when judges embrace social climate and contemporary conditions in reaching opinions while ignoring the U.S. Constitution. In reviewing the record of Sonia Sotomayor there is no doubt she fully supports judicial activism. Before the anger boils from everyone who considers themselves advocates of our Constitution pause and reflect on our modern history.
