Foods or beverages exempt from some or all of the competitive food and beverage rules are: Elementary schools: Individually sold portions of nuts, nut butters, seeds, eggs, cheese packaged for individual sale, fruit, non-fried vegetables, and legumes are exempt from the nutrition standards. Middle/junior high and high schools: Nuts, nut butters, seeds, eggs, cheese packaged for individual sale, fruit, non-fried vegetables, and legumes are exempt from the fat restriction. Cheese and eggs are exempt from the saturated fat restriction. Fruit and non-fried vegetables are exempt from the sugar restriction. No individually sold portions of the foods above are exempt from the calorie restriction. Under the federal regulations for FMNV, certain foods and beverages may be exempt and, therefore, not considered FMNV. Please note that a food may be exempt from the federal FMNV restrictions but not be exempt from state and/or local competitive food and beverage rules.
