No. The law applies to HMO, POS and PPO members enrolled in products underwritten by Tufts Health Plan (fully insured plans). The law does not apply to POS, PPO and EPO members who are enrolled in self-insured group plans, although some self-insured plans may choose to implement parity. The law mandates that coverage for the diagnosis and treatment of biologically based mental disorders cannot have annual or lifetime dollar maximums or coverage limitations on number of visits/days of service that are less than the limitations placed on coverage for the diagnosis and treatment of physical conditions. Tufts Health Plan members are covered for up to 24 medically necessary outpatient visits per year with a regular office copayment for non-biologically based illnesses.
