Are all residential premises covered under the Residential Tenancies Act (RTA)?

No. If you share bathroom or kitchen facilities with the owner and/or members of the owner’s immediate family, your living accommodations are not covered under the Residential Tenancies Act. In this type of accommodation, you are under the “house rules” of the landlord, which should be agreed upon by you and the landlord prior to entering into the tenancy. For answers to these and other legal concerns, contact the Landlord and Tenant Board at 1-888-332-3234 for further information. (Make sure you press “0” to get a live person). You can also view or print out a copy of the Act by visiting Ontario Residential Tenancies Act page.
