Are all juveniles handled in the juvenile justice system?
The juvenile justice system recognizes that not all juvenile delinquents can or should be handled under juvenile laws. Juveniles who are at least sixteen (16) years of age at the time of committing murder, attempted murder, kidnapping, rape, criminal deviate conduct, certain robberies, carjacking, criminal gang activity, criminal gang intimidation, carrying a handgun without a license, certain other firearms offenses, dealing in a sawed-off shotgun, or certain manufacturing or dealing of cocaine, narcotic drugs, methamphetamine, and controlled substances offenses are NOT handled under juvenile laws. These cases are automatically filed in the adult criminal system. Additionally, certain cases are “waived” or filed in the adult criminal system.
