Am I entitled to request personal information from my former employer under the data protection act?
Frankturk50 – this is the second time I’ve seen you post that they can only have computer records. THIS IS NOT THE CASE. Read up before giving people a bum steer! You may request all the information your empoyer has on you. However, they are entitled to keep some stuff to themselves if it is likely that they will have to defend themselves in a tribunal. You may possibly get access to these when the tribunal takes place. Also, it depends on if the letters of complaint were sent to the organisation in confidence. They may redact some information on this basis. www.ico.gov.uk and search for employment code of practice – this gives lots of information of what you can and can’t have in your situation. And better written than I can do justice to on this post. And just to reiterate – you can ask for anything on you so long it’s in a filing system and not randomly filed away – and even if this is the case, most organisations will provide it, all things being equal.
