Am I allowed to ask job applicants for details of any illnesses lasting more than three days over the past five years?
You can ask for such information, but be careful what you do with it. If you refuse to take someone on because of a medical condition which is a disability within the terms of the Disability Discrimination Act, you could find yourself fighting a discrimination claim, and/or required to make ‘reasonable adjustments’. If in any doubt, take specialist legal advice.
