Acceleration is not defined. What is to stop the Contractor claiming acceleration every time the Principal instructs the Contractor to catch up time ?
Where the Contractor is not achieving Scheduled Progress, the Principal may instruct the Contractor to take all reasonable steps to achieve Scheduled Progress, at the Contractor s cost, under clause 11. This is to be distinguished from an instruction (Acceleration Notice) to accelerate progress of the Works under clause 43. Providing the instruction to accelerate by way of an Acceleration Notice does not confuse clauses 11 and 43, there should not be any such claims.
