A contracting agency has entered into a contract to lease real property to a private party. Does the owner of the property have to provide proof of a BRC?
Yes. If the private company is a business engaged in purchasing or leasing real property the contracting agency must obtain proof of business registration from the private party before the lease is consummated. If the private party is not in the business of leasing real property, and the lease is incidental to some other purpose, then proof of registration is not needed. (See Section 8.
