What is a conditional use?
A Conditional Use grants a particular use to be allowed on a particular property, subject to compliance with the ordinances and the set of conditions attached to the permit. Conditional Uses are those which may be available to a property owner after a public hearing before the Planning and Zoning Board and the County Commission. 6. I don’t see the use I want on my property listed. It is the job of the Planning and Zoning Office to interpret the zoning ordinance. You should contact P & Z to discuss your proposed use. In many instances, if a use is not listed within a zoning district it is inferred that that use is not allowed within that district; particularly if that use is listed in another category. In some rare cases, the Planning and Zoning Administrator determines if a use is appropriate within a zoning district.
A conditional use permits a use of the property that the zoning of the property does not include. Conditional use permits are usually justified after a public hearing and a finding that they fit with the goals of the communitys master plan and are essential to the public interest. An example of a conditional use may be a nursery school operating in a residential-use only zone or a nursery school on a lot in an area that is zoned for residential use.
A conditional use is any use for land that may be proposed in the future, and is not a permitted use. To obtain permission to conduct the proposed use, the landowner must apply and appear before the BZA to explain the intended use and obtain the approval of the BZA. The BZA will follow certain common sense procedures outlined in the Growth Management Resolution, including notifying the neighbors of the hearing on the proposed use. In making its decision, the BZA must consider the list of standards set forth in Article XV. The standards are basically designed to enable all activities that are consistent with the rural/residential character of our Township, and which are compatible with the neighborhood in which located.
