Guess you never actually *read* The Constitution, huh? Pull out your copy and turn to Article 1, Section 8. It states, in part: “The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States;” That gives Congress all of the authority that it needs to pass a law implementing ANY tax, including income taxes. End of discussion! It’s a common misconception that the 16th Amendment to The Constitution authorizes an income tax. It does not. All that the 16th Amendment does is permit an income tax without apportionment. Due a Supreme Court ruling in the late 19th Century, income taxes were ruled to be direct levies subject to apportionment. That was impossible back in the 19th Century but would be child’s play in the modern computerized age, so be careful what you wish for. The 16th Amendment simply removed that judicial objection to income taxes.
