No. Sending a tax return that shows zero tax, along with a W-2 which testifies that you have been paid wages will only create a contradiction. The IRS will not refund your money because you submitted conflicting statements. The 1040 shows no tax due. The W-2 purports that 3401(a) wages and 3121(a) wages were paid to a Statutory Employee. They will most likely reject your return as frivolous because it is not in agreement with the W-2 and possibly impose penalties on you, for wasting their time. Question: The private sector company I work for sent the IRS a W-2, that by its very use alleges that they were a Statutory Employer, and paid wages to me. I do not believe that they are a Statutory Employer. I do not believe that I was paid wages. But the company I work for withheld money out of my paychecks and sent it to the IRS, for payment of the income tax. How can I get this money back?
