I dont believe I owe the income tax because I never received wages. Will the IRS refund my money if I file a zero return with a W-2, and claim the money that was withheld all year from my paychecks?
No. Sending a tax return that shows zero tax, along with a W-2 which testifies that you have been paid wages will only create a contradiction. The IRS will not refund your money because you submitted conflicting statements. The 1040 shows no tax due. The W-2 purports that 3401(a) wages and 3121(a) wages were paid to a Statutory Employee. They will most likely reject your return as frivolous because it is not in agreement with the W-2 and possibly impose penalties on you, for wasting their time.
