If the house is “won” by your hiusband you may be entitled to some pay out, ie if he buys you out of it. As long as your capital is below £16,000 you are entitled to caim housing benefit. It is means tested, so your award would depend on your income. If you give up you half of the property to your husband the council may take the view that you havedeliberatly deprived yourself of capital in order to claim housing benefit.
