How Are Certification Marks Used?
Trade Marks Ordinance 2001 provide for the filing of the regulations as an additional requirement for registration of certification marks (See second schedule to the Ord).The regulations governing the use of certification marks normally specify that in order for it to be valid, it must include: – who shall be authorized to use the certification mark, – characteristics to be certified by the the certification mark; – How the certifying body shall test those characteristics and supervise the use of the certification mark; – The fee if any to be paid in connection with the operation of mark and the procedures for resolving the disputes and any further requirements with which the regulations have to comply may be imposed.
