Decisions on parentage will be based on the parentage provisions within the Family Law Act and will only apply from 1 July 2009. Same–sex de facto couples will be recognised as parents where they meet the requirements of sections 60H and 60HB of the Family Law Act or where the child has been adopted by a same–sex couple, or the non–biological parent in the couple. Under section 60H of the Family Law Act, a child is recognised as a child of the birth mother and her female partner where: • the child is born as the result of an assisted conception procedure, and • the birth mother and her partner were in a de facto relationship at the time, and • both people agreed to the procedure at the time of conception.
