How do I request a legitimation?
If there is not a father on the certificate and the mother was not married at birth or anytime during pregnancy, a legitimation of birth can be completed. You can initiate that process at a county vital records office or the state office. A certified copy of the marriage license will be required and both parents will have to sign an affidavit in the presence of a notary. You will also need to request a certified copy of the birth certificate. If you and the father can not come onsite to a county vital records office or the state office, you may submit the request for a birth certificate and a certified copy of your marriage license by mail. Staff will review and determine if legitimation can be completed. Also, state that you want to add the father and provide a phone number where you can be reached during regular business hours.
