BitTorrent and .torrent files are completely legal (to some extent). They only contain text as data, nothing much more. If you use them to download copyrighted files then yes they are illegal (which is what they are usually used for).

It depemds on what your downloading. If it’s copyrighted material such as music or software, the no it is not legal. But there are plenty of things which are legal to download from torrents such as freeware for example!
