Can the perpetrator get out of jail once he/she is arrested?
The accused may be released after posting a bond in an amount set by law or the court. In addition the inmate may be eligible for various supervised, pre-trial release programs. In homicide cases, the accused may request a custody hearing before a Judge to determine if bail or other release is appropriate. In these cases, the court must make a determination that the defendant is “likely to be convicted” for the court to deny bail.
