Whos calling the shots at the DOJ?
I thought this bit from the TWI piece on the Couric Holder interview was revealing: Last night, Holder told Couric that after he took over the attorney general’s office, he asked lawyers in the Justice Department to see “if there’s a way where we can be more surgical, whether there is a way in which we can share more information.” My question is – which lawyers? Fresh faces with clear heads and a working knowledge of the Constitution, or “embedded” Bush Admin left-behinds? Based on recent developments, which do you think? It’s starting to sound like Obama is outsourcing this issue to Holder who’s passing it down the chain to some of the very same civil repressarians who developed the Bush State Secrets posture in the first place. And, for all of you who have been giving me grief for bringing up the possibility of a legislative solution to Executive immunity excess, this from the same article: Congress, meanwhile, may not leave the matter in Holder’s hands.
