How is a Trade Mark infringed?
q As a rule, a person infringes a registered Trade Mark if he uses, in the course of trade, a sign which is:- q identical and used in relation to identical goods and/or services; q likely to confuse the public because it is:- q identical and used in relation to similar goods and/or services; or q similar and used in relation to identical or similar goods and/or services; q identical or similar, used in relation to similar or dissimilar goods but such that the use of which takes unfair advantage of, or is detrimental to, any reputation that the Trade Mark has in the UK, or within the European Union for Community Trade Marks. This does not require the establishment of a likelihood of confusion.
