There are many reasons. One is if Immigration believes the person doesn’t actually fit in one of the categories mentioned above. Another is that many of the family-based and work-based categories have long waiting lists. If a person applies for her green card before she is at the top of the waiting list, her application will be denied. Most criminal convictions (even criminal charges that a person believes were dismissed may be considered as convictions under the immigration laws), having HIV, and earlier violations of the immigration laws (including being in the US with no valid legal status for more than 180 days) can also lead to denial of a person’s application for residency. In some cases, these reasons for denials can be overcome, particularly if the person has a permanent resident or US citizen parent or spouse.
