The age of consent for same sex couples in Victoria is the same as for heterosexual couples – 16 years of age. However, you cannot have sex with someone between the ages of 16 and 18 if they are under your care, supervision, or authority. There are further provisions that discuss and prohibit sex with persons with impaired mental functioning (mental illness, intellectual disability, dementia, brain injury).
