It is polar, but not for this reason. Carbon has an even lower EN than nitrogen, yet CO2 is apolar, because the two oxygens are arranged symmetrically around the carbon. NO2 on the other hand is angular (because the lone electron pair on the nitrogen), hence, the dipole moments of the two N-O bonds do not cancel out completely and the molecule as a whole is polar.
