What is the function of a trade-mark?
TM: The primary function of a trade-mark is to indicate origin. However, trade-marks also serve to guarantee the quality of the goods or merchandise bearing the mark and, through advertising, serve to create and maintain a demand for the product. Rights in a trade-mark are acquired only by use and the use must ordinarily continued if the rights so acquired are to be preserved. Registration of a trade-mark in the Canadian Trade-marks Office does not in itself create or establish any exclusive rights, but its recognition by the government of the right of the owner to use the mark in business to distinguish his product or goods from those of others.
