Property Tenure in simple terms refers to how the property is owned. Freehold is the simplest form of property tenure and is most commonly found in houses. Freehold means that you are the out-right and complete owner of the building and the land on which it stands. There could however be conditions on the freehold, despite the fact that you are the out-right owner, if in the deeds there have been restrictions set in place upon the initial build of the house, then any such restriction must be upheld. Leasehold is a little more complicated than freehold. Tenure is a guarantee of “due process” which is awarded to teachers after they have completed their probationary term. Prior to receiving tenure, teachers and teaching assistants “on probation” may be dismissed at any time. At or before the expiration of the probationary period, the district must deny or grant tenure. The board of education grants tenure following an observation and review process – but only after receiving the superintendent’s recommendation. Generally, the length of the probationary term is three years. Tenure is not transferable from one school district to another, however, those teachers who have come to the New Rochelle schools after receiving tenure in another school district

Tenure is time-limited ownership of a specific parcel of subsurface petroleum and natural gas rights. Tenure confers the right to apply to the Oil and Gas Commission (OGC) to access, explore and develop the petroleum and natural gas according to applicable statutory regulations. Tenure is not required to drill test holes; however, industry must obtain permission from the OGC before drilling. In order to produce coalbed gas (CBG), industry must acquire Petroleum and Natural Gas (PNG) tenure rights. The Ministry of Energy and Mines Titles Division is responsible for issuing and administering provincially owned PNG rights. Tenure is sold monthly, based on requests from industry for specific parcels. Tenure is typically awarded to the highest bidder; however, not every parcel offered is purchased. There may be no bids received or the bids are deemed to be unacceptable, as they do not provide sufficient return to the province based on a technical evaluation. [BACK TO TOP] Does tenure preven
