“Incorporation by Reference” is a legal tool that permits an agency to make all or part of a document drafted by someone else part of the agency’s rule. The Utah Administrative Rulemaking Act permits you to incorporate certain types of documents into your rule by reference. These include: • a code, rule, or regulation adopted by: • a federal agency; • another state agency; • a political subdivision of Utah; • an agency of another state; or • a nationally recognized organization or association; • state implementation plans mandated by the federal government for participation in the federal program; • lists, tables, illustrations or similar materials that are: • subject to frequent change; • fully described in the rule; and • available for public inspection; or • lists, tables, illustrations or similar materials that are determined by the director of the Division of Administrative Rules to be too expensive to reproduce in the Utah Administrative Code.
